TAMRA, Thailand — The Chinese government says the drugmaker is doing everything possible to block a potential legal challenge by the U. S. Food and Drug Administration, but the move by the company could prove to be a game-changer for the anti-impotence drug.
The drugmaker said on Thursday that it had received a call from Chinese regulators about possible competition from a generic version of Viagra.
“We have received a lot of reports of potential legal challenges,” said Eli Lilly and Company president and CEO, Peter Kramer. “We are very concerned about the potential for legal issues.”
The FDA has been reluctant to comment on the pending case until after U. District Judge James M. Kennedy issued a ruling Friday that would prevent similar drugmakers from marketing Viagra, the little blue pill that treats erectile dysfunction.
The agency says it will take the case to trial, and will decide on Thursday if any new cases will be heard by the court. If the court determines that the FDA is justified in blocking Viagra, it will decide on Thursday whether to appeal.
The Viagra maker said that it has no plans to appeal any of the earlier rulings, and the drugmaker has agreed to pay a $750 million settlement to resolve a $25 billion lawsuit it filed against the Chinese pharmaceutical firm in June.
“Our hope is that the court can rule on the merits of this case and, if necessary, we can move forward with our pending appeal,” Kramer said.
Lilly’s new legal action, filed under the heading “Patent cliff,” will likely be a case in which generic competition would prevent other drugmakers from developing a cheaper version, he said.
Under a U. patent, a drugmaker can make a drug, which can only be sold in a licensed marketplace. A generic may be approved for only a certain number of years, typically up to a maximum of four years.
Lilly has argued that the patent in question has an “intolerable” risk of losing its patent protection. But the company said it would take a case study to determine whether that risk might be greater than the current market price.
The U. patent for Viagra, for the treatment of erectile dysfunction, expires on December 31, 2015, if approved by the U. Food and Drug Administration. Lilly and the drugmaker expect the patent to go into effect in October 2016.
Patent loss is a common challenge, but the company said that it has tried to protect it, but has not found any meaningful way to do so, or to protect a patent from losing its protection. It has not sought to recover costs or revenue from the patent loss.
Lilly’s lawsuit also contends that the company, which is seeking a $2 billion settlement to resolve an ongoing patent litigation, has not shown that the generic drugmaker can meet its patent protection claims in court.
Lilly and the drugmaker will continue to participate in negotiations with other drugmakers, and if they reach an agreement, the judge will decide whether to approve the settlement or deny it altogether.
“This is the first of many legal challenges to the Chinese pharmaceutical company’s patent and it is our hope that it can finally be resolved through trial and trial,” Kramer said.
A spokesman for Eli Lilly said that there were no pending patent infringement suits in the United States, but that the company had not yet filed a patent infringement suit in the European Union, the United Kingdom or Australia.
